There are various classes in which the Trademark is classified and needs to be registered according to the class it relates. A separate trademark registration application is required to get the trademark registered in different class.
The trademark can be applied by any one who uses or intends to use a brand name, or logo for some commercial purpose. The trademark owner can be an individual, business organization, charitable trust or Government agency.

Normally, it takes a single day to apply for registration of trademark. However, the process, of checking, verification, objection (if any) and registration takes a period of around One year in India. Nevertheless, every startup can start using the Trademark upon successful application is made.
The validity of registration of trademark is 10 (Ten) years, and can be renewed for every 10 year. An application for renewal of a trademark can be filed within six months from the date of expiry of the registration of trademark.
Generally, one who has filed an application (pending registration) can use the Symbol next to the brand name to alert the public of owners exclusive right on use of the brand name. The symbol (R) shall only be used when the trade mark is registered.
